NEW RULES FOR INTELLECTUAL PROPERTY REGISTRATIONS
On June 23rd India’s Controller General of Patents, Designs and Trademarks has placed in the public domain details of pending trademark applications, registered trademarks, examination reports, copy of applications, opposition to such applications, and other information  to increase transparency into the workings of the department. According to IP law experts the opening up of trademark data is a significant milestone in the history of Indian IP. It will change the way trademark law is practiced in India and ordinary citizens who wish to register trademarks can conduct their own searches without going through expensive attorneys.

TAX CODE: GOVERNMENT PLANS TO LOW CORPORATE TAX TO 25%

The Finance Ministry has released a draft Direct Taxes Code which proposes to reduce the rate of tax for companies from 30% to 25%. In addition to direct corporate income tax, companies in India are subject to a minimum alternative tax, wealth tax, capital gains tax, fringe benefits tax, and indirect taxes such as value-added tax (VAT), service tax, excise duties and various levies of individual states and municipality taxes. Tax incentives focus mainly on the setting up of new industries, encouraging investments in infrastructure, power and promoting exports. Export and other foreign-exchange earnings were previously favored with income tax incentives but these have generally been phased out except for predominantly export-oriented units.

INDIA & EU PUSH FOR FREE TRADE AGREEMENT BY END OF THE YEAR
India and the European Union (EU) are pressing to complete a bilateral free-trade agreement by the end of this  year said the Indian Minister of Commerce Mr. Anand Sharma speaking at a Global India Business Meeting in Europe last week. Sharma said that “in principle” an agreement between India and the EU on the FTA was likely to be had by the end of this year. The EU and India launched negotiations for an FTA in 2007. As a bloc, the 27-nation EU is India's largest trading partner but talks have snagged over differences about market access, procurement and the EU's efforts to link trade with issues such as child labour. The EU has been seeking to include global warming, intellectual property rights and child-labour but India has opposed the incorporation of what it calls extraneous non-trade issues. NEW RULES & REGULATIONS


PAYMENT MADE ABROAD TAXABLE IF DEAL HAS LINKS WITH INDIA
The Income-tax department can tax even a payment made to a foreign entity outside India, if the transaction has a business connection within the country, according to a verdict passed by the Income Tax Appellate Tribunal, Mumbai. The ITAT said that India does not follow territorial taxation method in its income tax and it is not necessary that the party have a business activity in India (territorial nexus). A division bench of ITAT held that tax is payable in India on any income which is either sourced from India or which arises to a person domiciled in India. The ITAT drew support for its decision from the amendment made in the relevant I-T laws in the Finance Act 2010. For more information Click Here

INCREASE FDI IN THE DEFENSE PRODUCTION DEPARTMENT AND MULTI BRAND RETAIL SECTOR:
The Ministry of Commerce and industry may increase Foreign Direct Investment (FDI) in the Defense sector to 74% from 26% for the purpose of encouraging local manufacture and technology. However, the Defense industry prefers a limit of 49% so that the control remains in hands of Indians. Along with this, the commerce and industry ministry is also likely to propose 100% foreign direct investment (FDI) in multi-brand retail. FDI in multi-brand retail will enhance supply-chain efficiencies, give farmers better earnings and reduce wastage. Finance minister Pranab Mukherjee said that opening retail trade would help in bringing down the considerable difference between the farm gate prices, wholesale prices and retail prices. It is in this background that a delegation led by Shri Radhakrishna Vikhe Patil, Hon. Minister for Ports, Government of Maharashtra will be visiting the Port of Venice on 5th July, 2010. The main objectives of the visit would be to gather information about the port and its activities, (ii) To know about the technologies for both construction and operation of the port and (iii) To know about future plans of the port vis-à-vis their expansion in the country and overseas.

VESPA COMES BACK TO INDIA
Piaggio & Co plans to invest nearly 30 million over the next two years to establish a 1.5-lakh capacity plant that will produce a model specially developed for India, the world’s second-largest two-wheeler market. The first scooters are to roll out by the end of 2012. Vespa first entered India in the late 1950s through a joint venture agreement with the Firodias who were then part of the Bajaj group. Piaggio, intends on establishing boutique showrooms for selling the Vespa range of scooters and hopes to make at the rate of about 150,000 units a year within a couple of years of establishing its all-new plant for scooters by launching Vespa with 100cc and 150cc engines. The company is also considering tapping its existing network of 800 touchpoints across the country to promote the vehicle.For more information Click Here

LAMBORGHINI LAUNCHES MURCIELAGO LP 670-4 IN INDIA
Italian luxury carmaker, Lamborghini unveiled the limited edition of its fastest sports car Murcielago LP 670-4 SuperVeloce in India priced at Rs 3.6 crore (ex-showroom). The new car comes with a 6.5 litre V12 petrol engine and can speed from zero to 100 kilometer per hour in 3.2 seconds. Exclusive Motors is the sole distributor of Lamborghini in the country and also operates the only Indian dealership of the Italian carmaker in Delhi. The new car will be shipped-in as a completely built unit (CBU) from Lamborghini's facility at Sant'Agata in Italy.

STILE BERTONE TO DESIGN INDIAN ECO-FRIENDLY CAR BY MAHINDRA & MAHINDRA
Mahindra & Mahindra is aiming to enter the small car segment in India. It has already acquired stake in Reva Electric Company to introduce an eco-friendly car in its product portfolio. The company is aiming to invest over Rs. 1000 crore in India to diversify into small car segment. M&M is aiming to bring its small car in India by 2013-14, which will be priced, in a bandwidth of Rs. 2-5 lakh. The small car will be designed by Italian car design studio Stile Bertone that initially designed Xylo for the Indian market.

TATA NANO: ITALIAN TRILIX DESIGN TO HELP FOR EUROPEAN VERSION
Tata Motors is now gearing up to introduce Nano, the world’s cheapest car, in recession-hit European countries. Tata Motors has consulted Italian firm Trilix Design and Engineering Solutions. Adreas Werner, region president (India) for Bosch Limited, one of the suppliers of critical parts to Nano, said the small car in its present form would require changes in engine to meet European standards.

LUCCHINI ENTERS JV WITH BHARAT CONNECT FOR RAILWAY SYSTEMS
Italian company Lucchini entered a Joint Venture with Indian company Srei Infrastructure of the Bharat Connect Group. The new company shall be called Lucchini (I) Pvt. Ltd. Srei Infrastructure will have a stake of 45%  and Lucchini 55% stake. The agreement has been signed and the company would be receiving soon a Letter of Incorporation from the Registrar of Companies. The factory would be in Pune but the Head Office would be in Kolkata. The company will manufacture Wheel and Axles for high-speed locomotives and metros  products in high demand now in India. ARTSANA PLANS R&D CENTRE FOR BABY CARE PRODUCTS IN INDIA
The company Artsana sells the 'Chicco' brand of baby care products in India and opened its first flagship outlet in April this year. The Chicco brand caters to six baby product segments - apparels, footwear, toiletries, nursery items, toys and juvenile goods (like prams) -- for babies in the age group of 0-3 age group. The R&D center will come up at Gurgaon by year-end. FINANCE: ITALIAN FIRM EXOR COMMITS $100M IN INDIA-FOCUSED FUND
Exor SpA, a leading investment company in Europe, is putting in up to $100 million (about Rs 469 crore) in a $250-million (about Rs 1,173 crore) fund which is looking at opportunities for private equity investments in India and China. Exor is controlled by the Agnelli family of Italy and is listed on the Italian stock exchange. It currently has net assets of around €6 billion (about Rs 33,994 crore), and owns majority in Fiat Group, the global auto manufacturer. In a recent interview with Indian TV Kabir Bedi announced his intention to bring the show to India.  “It’s quite sad that the show was never seen by majority of Indian folks despite being an international hit, soI have decided to get it here.” Kabir has started dubbing for the show in Hindi. “I have secured the rights of the show and have started dubbing myself. I will be talking to channels for the show and I am quite hopeful. In the worst case scenario, even if it doesn’t get any channel I will be launching it on DVDs since home video market is growing rapidly in India,” he adds. Though he has always been active on TV internationally, he has practically stayed away from TV in India.
